We have acted for the developer of this magnificent resort project through all phases of its acquisition and development. Initially, we assisted the developer in negotiating, preparing and completing the contract to purchase the land and existing resort business, then liaising with the Shire of Busselton and other statutory authorities to clear all the conditions of subdivision and development and registering a survey - strata plan of subdivision.
The resort is operated as a management rights scheme which involves a management system and documentation which complies with laws and policies administered by the Australian Securities and Investments Commission. We prepared all the documents and provided all the legal advice required to achieve this outcome. The sale of the apartments at the resort has been very successful and the resort is due to open in 2007.

We acted for the developer when it purchased the vacant land in Wellington Street which was formerly occupied by the Metropolitan Markets. We assisted with obtaining approvals to subdivide the land, clearing the conditions of subdivision approval and preparing various covenants and easements which were required in order to provide the efficient integration of this multi-purpose site.
The land is now the home of the highly successful “Harbour Town” brand direct shopping centre and the Royal Automobile Club of WA. We assisted the developer in setting up standard lease documentation for the shopping centre and negotiating development and sale of the shopping centre, the RAC building and the remaining lots on the site.

We act for the responsible entity which operates this highly successful property trust which has accumulated a superb portfolio of industrial properties throughout Australia since its inception in 2002.
We assisted our client to establish the trust by drafting and registering the trust’s constitution at the Australian Securities and Investments Commission and guiding our client through the complex legislation and policies which regulate managed investment schemes in Australia.
Since the trust was established, we have assisted our client in the purchase and leasing of many of the properties which form part of the national portfolio.

We act for the developer of this luxury, strata title residential development overlooking the Indian Ocean in the rapidly changing, beachside suburb of Rockingham.
Initially, we acted for the developer in negotiating, preparing and settling the contract to purchase the land for the project.
We then assisted our client in dealing with the planning and construction issues which needed legal attention and input.
The viability of this type of project depends on a successful marketing campaign to sell the strata title apartments “off the plan” before construction begins. We assisted our client by drafting and advising on the content of the sales contracts and related compliance issues. The marketing campaign was highly successful and the building was completed and opened in 2006.

We acted for the joint venture developers of this project located on and forming part of the Adelaide Airport land adjacent to Tapleys Hill Road, West Beach, Adelaide.
Initially, we assisted the joint venture developers to establish their joint venture structure and agreement. We acted in the negotiation and preparation of a development agreement and a long term ground lease of the site which involved extensive negotiations with the operators of the Adelaide Airport and the Commonwealth of Australia which owns the airport.
The site is now home to the highly successful “Harbour Town” brand outlet centre. We also assisted the developers by preparing the standard retail lease for tenants at the centre and advising in respect of further stages of development at the site.
We act for the two retail property trusts which jointly own this popular shopping centre, south of Perth.
We acted on the purchase of each 50% interest in the centre undertaking extensive due diligence, reviewing leases and negotiating and settling contracts for the purchase of the centre. We now handle the ongoing leasing of the centre and assist the owner and its managing agent in handling the legal issues which arise from time to time.
We have extensive experience in advising on the retail tenancy legislation in Western Australia and dealing with complicated and difficult tenancy situations. This is one of several retail shopping centres with which we are involved.
We act for the owner of this land which is being developed as a survey - strata titled residential subdivision.
Initially, we acted on the negotiations for and preparation of the option and contract to purchase the land and the settlement of the purchase of the land. Our client also raised investment capital through a public share issue to investors wishing to participate in the project.
We assisted our client with advice on the structure of the new company, advice on its obligations under relevant legislation regulating fund raising and the preparation of an information memorandum. The capital raising was very successful; our client completed the purchase of the land and is now proceeding with a residential land subdivision involving the sale of house and land packages.
We act for the property trust which owns this office building located at the premier intersection of Perth’s central business district.
Initially, we assisted our client to establish the property trust by drafting and registering the trust’s constitution at the Australian Securities and Investments Commission and guiding our client through the complex legislation and policies which regulate managed investment schemes in Australia.
We acted on the purchase of the property, assisting our client to negotiate and prepare the contract. We carried out the necessary legal due diligence investigations for our client and acted on the settlement of the purchase. Since that time, we have assisted our client with the ongoing leasing of the building and in handling the property management issues which arise from time to time.
